Fair Use Policy
This Fair Use Policy describes acceptable and prohibited uses of ProspectLocal (the "Service"). It applies to everyone who uses the Service and forms part of our Terms of Service. Its goal is to keep the Service reliable, lawful, and fair for all customers.
1. Prohibited Activities
You must not use the Service to:
- break any law or regulation, or infringe anyone's intellectual-property or privacy rights;
- send unsolicited commercial electronic messages in violation of CASL or other anti-spam law;
- transmit malware, phishing, deceptive, or fraudulent content;
- harvest, scrape, or collect data in violation of a third party's terms (including the Google Maps Platform terms) or applicable law;
- attempt to gain unauthorized access to the Service, other accounts, or our systems;
- reverse engineer, resell, or sublicense the Service except as permitted by law or by us in writing;
- place an unreasonable load on our infrastructure or interfere with other customers' use; or
- share a single account among multiple users beyond the seats allowed by your plan.
2. Email Sending Standards
Outreach you send through the Service must comply with our Anti-Spam & CASL Policy. You must use accurate sender information, include the required identification and unsubscribe mechanism, honour opt-outs promptly, and only contact recipients for whom you have a lawful basis. We enforce sending windows, daily limits, and other safeguards, and we may further limit volume to protect deliverability and our sending reputation.
3. Data Sourcing Responsibilities
You are responsible for the prospect and contact data you bring into or generate within the Service, including ensuring it was obtained lawfully and that your intended use is permitted. AI-generated enrichment and content are provided to assist you and may be inaccurate; you are responsible for reviewing them before use.
4. Fair Use of Resources
Plan limits (such as searches per day, prospects per month, campaigns, and seats) exist to ensure fair access. Automated or bulk usage that circumvents these limits, or that is designed to extract data at a scale inconsistent with normal use, is prohibited.
5. Enforcement
If we believe you have violated this policy, we may throttle, suspend, or terminate your access, with or without notice depending on the severity, and we may report unlawful activity to the appropriate authorities. We may also remove content that violates this policy or the law.
