Anti-Spam & CASL Policy
Canada's Anti-Spam Legislation ("CASL") governs the sending of commercial electronic messages ("CEMs"), including the cold-outreach emails you can create and send through ProspectLocal. This policy explains your obligations and the tools we provide. You are the sender of your messages and are responsible for CASL compliance.
1. What CASL Covers
A CEM is any electronic message that encourages participation in a commercial activity. Under CASL, before sending a CEM you generally need (a) consent, (b) clear identification of who is sending the message, and (c) a working unsubscribe mechanism.
2. Consent
CASL recognizes express consent and certain categories of implied consent (for example, an existing business relationship, or a conspicuously published business email address where the message is relevant to that person's role and the address is not accompanied by a statement that they do not wish to receive messages). You are responsible for confirming you have a valid basis to contact each recipient and for keeping records of that basis.
3. Required Message Content
- Identification — your name or business name and how you can be contacted (mailing address and an email address or website that is valid for at least 60 days).
- Unsubscribe mechanism — a clear, working way to opt out at no cost.
The Service can add a configurable CASL footer and a one-click unsubscribe link to your messages to help you meet these requirements, but it is your responsibility to ensure each message is complete and accurate.
4. Unsubscribe Handling
CASL requires that opt-out requests be honoured without delay, and in any event within 10 business days. The Service records unsubscribes and suppresses future sends to opted-out addresses; you must not override or circumvent these suppressions.
5. Your Responsibilities
- Only contact recipients for whom you have a lawful basis under CASL.
- Use truthful sender and subject information.
- Maintain records of consent and unsubscribe requests.
- Stop contacting anyone who opts out or asks you to stop.
6. Records and Penalties
We retain unsubscribe and sending records associated with your account to support compliance. CASL provides for significant administrative monetary penalties for violations. We may suspend accounts that generate excessive complaints or that we reasonably believe are violating CASL.
